MEDIATION WITH A MEDIATION TEAM

Best for couples who will struggle to negotiate directly with their partner and would benefit from having a team of professionals, including a mental health professional, to guide them through the divorce mediation process.

MEDIATION WITH ATTORNEY MEDIATOR

Our Attorney Mediator will work with both of you to reach a resolution. We do not represent one side or the other; we maintain our neutrality to help you both reach an agreement that you both agree is fair and equitable. Whether you believe you can resolve most issues on your own or prefer to work with one neutral professional to save time and costs, we offer comprehensive services. These services include drafting and executing all the necessary documents so you are prepared for the one hearing you will have before the Court to finalize your divorce. We know that costs are a significant concern for couples starting the divorce process, and that’s why we offer you the choice of a fixed-fee program or pay-as-you-go with our hourly program. MEDIATION WITH A MEDIATION TEAM

Attorney Mediator, Divorce Coach, and Financial Analyst
Our Attorney Mediator acts as the primary mediator with a team of professionals. Couples have the option to work with a Co-Parenting Mediator, a licensed mental health professional, to create their parenting agreement and a Financial Neutral to assist in resolving any issues related to property and asset division along with support. Your team works for you as neutral experts focused on creating personalized and lasting agreements.

The Co-Parenting Mediators are child specialists with experience working with families going through divorce. Whether it's consultation on how and when to discuss the separation with your children, identifying a schedule that will work best for your family, or meeting with your children to provide a voice for your children in this process, the Co-Parenting Mediators are great assets to your mediation team.

Wisconsin Divorce Solutions collaborates with Divorce Financial Mediators to help couples resolve financial issues with the advice of a Certified Divorce Financial Analyst. The Financial Analyst assists both parties with identifying their budgets and financial needs, and works with your Attorney Mediator to help you explore and understand the range of options available to you both as we strive to secure the mutually beneficial solution.

Mediation/Arbitration/or Med-Arb with Attorney Advocates
Whether you currently have attorneys or are planning to hire attorneys, we can help you manage costs and time by offering mediation, arbitration, and med-arb (mediation-arbitration).

Did you know that a litigated divorce can easily last for two years or longer? It takes attorneys a lot of time and resources to prepare a case for trial before a Judge. There are also significant time delays as the Court’s calendar typically books months in advance. Finally, even after your trial before the Court, the Judge has 90 days (or longer) to issue a decision in your case. If either of you disagree with the decision, there is the opportunity to file a motion for reconsideration or an appeal which will drag the process out even farther.

This process is ideal for couples who are not comfortable being in the same room with their partners due to a history of violence, manipulation, or power imbalances. It is also a good process for those who prefer to have their own lawyer to advise them throughout the process.

There are many excellent litigation attorneys out there. Talk to your attorney as to whether mediation, arbitration, or med-arb would be a good option for you.
How is Mediation Different from Arbitration?
In mediation, we assist with the negotiation process and help seek an amicable resolution to divorce issues. A resolution will only be reached after both parties agree. Instead of going to trial, the mediator helps resolve disputes quickly and avoid ongoing costly litigation.
Conversely, in arbitration, both of you will be making your case to an independent arbitrator. It requires both parties to provide evidence and present testimonies. Arbitration is similar to a divorce trial but less formal, less costly, and takes less time. After listening to the evidence, the arbitrator will be the one who makes the final decision.
What is Med-Arb?
Med-Arb is a dispute resolution process that combines both mediation and arbitration. At the onset, the mediator will be working with you to reach a settlement agreement through mediation. However, if you reach an impasse (a situation in which no progress is possible) on certain divorce issues, the mediator can then become the arbitrator who will be the one to make the decisions to ultimately resolve all outstanding issues.
